The Marietta Municipal Court handles misdemeanors such as DUI, possession of less than one ounce of marijuana, shoplifting, assault and battery, domestic violence, and traffic cases, such as speeding, running red lights, reckless driving, and other traffic violations. It is a court of limited jurisdiction and does not have the authority to handle jury trials. All defendants requesting a jury trial have their cases bound over to the Cobb County State Court for a jury trial.
The Solicitor is Robert Donovan, and the Judge is Roger Rozen, both appointed to their positions by the Marietta City Council and have been in their positions for 30 + years. I have known these gentlemen for their entire careers. They are very professional and work hard to achieve the goals of the court.
Judge Rozen is the Secretary and Treasurer of the condominium association of which I am the President. All of us have had the pleasure of working together for many years.
When the City of Marietta built their current Court House and Police Department, they did not build a jail and use the jails at Smyrna and the Cobb County Adult Detention Center for those arrested by the Marietta Police.
We always try to dispose of cases in the Marietta Municipal Court first. If our client wants a jury trial, we bind the case over to the Cobb County State Court for a jury trial.
Like Marietta, the Smyrna Municipal Court handles misdemeanors only. The Solicitor is William Morse, and the Judge is Alton Curtis, both appointed to their positions by the Smyrna City Council and have been in their positions for 10 + years. I have known these gentlemen for their entire careers, including those years when they were Defense Attorneys, before they took their current positions. This is a court of limited jurisdiction and does not conduct jury trials. For those who want a jury trial, their cases are bound over to the Cobb County State Court for a jury trial.
